Rights and duties of users

The French law of March 11, 1957 authorizing, under the terms of paragraphs 2 and 3 of article 41, on the one hand, only “copies or reproductions strictly reserved for the private use of the copyist and not intended for collective use”, and, on the other hand, only analyses and short quotations for purposes of example and illustration, “any representation or reproduction in whole or in part, made without the consent of the author or his successors in title or assigns, is unlawful” (paragraph 1 of article 40).
Any representation or reproduction, by any process whatsoever, would thus constitute an infringement punishable by articles 425 and following of the Penal Code.

Hypertext links

The establishment of hypertext links by third parties to pages or documents published on the site is authorized provided that the links do not contravene the interests of AgroParisTech, and that they guarantee the possibility for the user to identify the origin and author of the document.

Privacy policy

The purpose of this privacy policy is to inform visitors or users of the www.waterforall.utilities.management website of the means implemented to :

– Collect and process the User’s personal data, in accordance with the Law n°78-17 of January 6, 1978 relating to data processing, files and liberties as modified by the law of June 20, 2018, the Order n° 2018-1125 of December 12, 2018 modifying the law n° 78-17 of January 6, 1978 relating to data processing, files, freedoms and various provisions concerning the protection of personal data, as well as Regulation n°2016-679 of April 27, 2016 relating to the protection of individuals with regard to the processing of personal data and the free movement of such data
– Consult, process and store information relating to the User’s browsing on the Site that may be recorded via “cookie” files.

The Policy may be modified at any time by the APT-SUEZ Chair, in particular in order to comply with any regulatory, jurisprudential, editorial or technical changes. The User must refer to the latest version of the Policy before any browsing.
This Privacy Policy is an integral part of the Website’s General Conditions of Use.

Protection of personal data
When the User uses the Website, the APT-SUEZ Chair may collect and process personal data in order to enable the User to access the services offered by the Website. In the context of each data entry form, the APT-SUEZ Chair undertakes to limit the collection of data to what is strictly necessary for the purpose in question.
The data collected are contact data, data published voluntarily by the user (message or subject of the request) and navigation data (collected using cookies).
The Data collected within the framework of the use of the Site are subject to processing in order to meet the following purposes in particular:
– The management of the User’s requests to answer any other request for information formulated directly in the dedicated form ;
– The management of access to certain Services as well as their use;
– The elaboration of statistics and measurements of site traffic.

The User manifests his consent to contract by filling out the appropriate contact form(s) and providing his or her contact information. The APT-SUEZ Chair executes the contract by responding to the User’s request and sending the information by email (or by post if necessary). This contractual performance implies knowing the identity of the User and the possibility of interacting with him/her. The APT-SUEZ Chair may also process certain Data on the basis of legitimate interest (in particular to ensure the security of the Website) or on the basis of the User’s express consent.
The database created when a User sends a request via a contact form is strictly confidential. The APT-SUEZ Chair undertakes to take all useful precautions and appropriate organizational and technical measures to preserve the security, integrity and confidentiality of the Data and, in particular, to prevent it from being distorted, damaged or accessed by unauthorized third parties.

The Data collected through the various forms is intended for the internal services of the APT-SUEZ Chair responsible for responding to the User’s request. The Data may also be transferred/used by third parties under the following conditions:


1-Data transferred to public authorities and/or bodies

In accordance with the Regulations in force, the Data may be transmitted to the competent authorities upon request and in particular to public bodies, exclusively to meet legal obligations, judicial officers, judicial officers and bodies in charge of debt collection, as well as in the case of the search for the perpetrators of offences committed on the Internet.

2-Data transferred to third parties

The IT and/or technical department of the APT-SUEZ Chair will have access to the Data collected in the context of the use of the Website.

3-Social Networks

If the User has an account on a social network (such as Facebook, Twitter, LinkedIn, YouTube) and accesses the Website without having previously used the Services, the APT-SUEZ Chair may receive information from said social network in order to facilitate the completion of the contact form. The information published by the User on the Website is not transmitted to social networks.

In the event that the User uses a Service via a social network, the User allows the APT-SUEZ Chair to access certain information that he or she has provided to the social network, such as his or her user name, first and last name, profile image, and data relating to the use of this Service. The User also authorises the APT-SUEZ Chair to collect, store and use all the information that the User has provided to the social network.
Access to Personal Data by the User
In accordance with the Regulations, any individual has the right to access, rectify, delete, limit and carry the Data concerning him/her. These rights may be exercised at any time by sending proof of identity:

In the event of any difficulty concerning the management of your personal data by the APT-SUEZ Chair, you may submit a complaint to the competent protection authority (in France: CNIL – 3, place de Fontenoy – TSA 80715 – 75334 Paris Cedex 07).
The APT-SUEZ Chair reminds you that any individual may, for legitimate reasons, oppose the processing of Data concerning him or her.

Data Retention and Archiving

User Data will not be retained beyond the time strictly necessary for the purposes set forth herein and in accordance with the Regulation. In this respect, the Data collected in order to manage the User’s requests for information are kept for the time necessary to process the request in active base, then for a period of 3 years in intermediate archiving, except for requests relating to ethical alerts, which are subject to a retention period in accordance with the obligations arising from the applicable regulations and the recommendations of the CNIL. Nevertheless, the Data may be archived beyond the periods provided for the purposes of research, observation, and prosecution of criminal offences in order to allow, as needed, the availability of these Data to the judicial authority or to defend themselves in the context of possible legal actions. The User Data will be erased upon the express expiration of the retention periods.
In addition, the APT-SUEZ Chair is likely to keep Data permanently anonymised for the purposes of producing statistical studies. Under no circumstances do these studies make it possible to identify Users, and only concern trends derived from their aggregate Data.

Security

The APT-SUEZ Chair takes adequate technical and organisational measures to ensure Data security and to prohibit unauthorised access to or disclosure of User Data. However, the APT-SUEZ Chair cannot guarantee the elimination of any risk of misappropriation, alteration, illicit reproduction or misuse of Data.
